Dare County man pleads guilty to one count felony indecent liberties with child, has 7 other child-related sexual charges dropped, is now on probation in Southern Shores

SOUTHERN SHORES — A former Nags Head resident who was arrested in April pleaded guilty to a sexual crime against a child, received a sentence of mostly probation per his plea agreement and now lives in Southern Shores, official records show.

 

Charles Everett Holland II, listed as 62 and as 59 in various official records, registered as a sex offender on Monday, July 7, providing his address as in the 100 block of Duck Woods Drive in Southern Shores on the North Carolina State Bureau of Investigation (SBI) sex offender registry.


Dare County property records show that Holland does not own the home where he registered.

 

Holland pleaded guilty to one count of felony indecent liberties with a child, who was 7 years old at the time of the offense, on Wednesday, June 4, before Judge R. Andrew Womble. The date range listed for his offense was from April 1, 2021, to August 26, 2024.

 

As part of Holland’s plea arrangement with the district attorney, the seven other various felony charges of sexual crimes against a child were dismissed, according to court documents.

 

A “crime against nature” charge from the same case was dismissed, as were six charges from a separately opened case against him: One count of attempted first-degree forcible sexual offense, four counts of indecent liberties with a child and one count of disseminating obscene material to minors under the age of 13.

 

It is immediately unclear how many child victims might have been involved. The April 7 magistrate’s order listed the victim’s age as 10 at the time of the two initial alleged offenses, and the dissemination charge pluralized “minors.”

 

Holland was sentenced to five years of supervised probation and an active term of incarceration for 90 days in the custody of the Dare County Sheriff’s Office, with credit toward that sentence awarded for the 58 days he was in jail awaiting judgment.

 

He is required to complete 100 hours of community service in 12 months and to be listed on the SBI sex offender registry for a minimum of 10 years, records show.

 

As other conditions listed as part of his probation sentencing, Holland is not allowed to maintain any social media accounts, nor is he to possess any print, video or computer images depicting the sexual abuse or sexual exploitation of children.

 

Holland is also required “to obtain mental health assessment and psychosexual assessment and [to] comply with any treatment recommended,” to participate in any programs as directed by his probation officer and to pay a $40 monthly supervision fee, in addition to other court costs, according to court records.

 

Holland’s suspended sentence—meaning the time he would be incarcerated should he not comply with the terms of his probation—is 16-29 months.

 

Holland was not classified as a “sexually violent predator pursuant to G.S. 14-208.20,” nor was he required to enroll in satellite-based monitoring, court records show.


Holland was listed as a 62-year-old resident of the 4600 block of South Blue Marlin Way in Nags Head on initial court documents, including his arrest warrant and magistrate’s order.

 

Subsequent court documents show his age as 59 instead, as does the SBI sex offender registry listing. The North Carolina Department of Adult Correction website lists him as 62.

 

An officer with the Nags Head Police Department arrested Holland on Monday, April 7, on one count of indecent liberties with a child and one count of crime against nature, according to the magistrate’s order.

 

Outer Banks Insider broke the news of his arrest in a Thursday, April 10, article, after confirming with town officials that the investigation was ongoing. Law enforcement also opened a second case against Holland with six additional charges that day.

 

The next day, the Town of Nags Head issued a press release to all area media outlets about Holland’s arrest that encouraged anyone with information about the active investigation to contact the police department.
